Resident Alien'Duty Many of foreigners who arrive in Thailand do not know what their duties are or what they have to do next the following summarizes Alien's compliances in accordance with Immigration Act B.E.2522 Summary The alien who is allowed to work in Thailand must have a work permit in addition, if he/she stays in Thailand longer than ninety days, he/she must notify competent official at the Immigration Division concerning his place of stay following Tor Mor 47 form The alien is required to do so every ninety days from the time of arrival Section 38 : The Household - Master, the landlord of the residence, or the Hotel Manager of where the alien is staying must notify the competent official of the Immigration Office located in the same area within 24 hours from the time of arrival of the alien concerned. if there is no Immigration Office located in that area, the local police official for that area must be notified. In case the house dwelling place, or hotel where the alien has stayed under provision of Paragraph.1 is located whthin Bangkok area such notification must be reported to the competent official at the Immigration Office Summary The Household - Master, the landlord of the residence, or the Hotel Manager of where the alien is staying must notify the competent official of the Immigration Office within 24 hours. Section 39 : After having received permission for temporary entry into the Kingdom if the alien leaves the Kingdom it is considered that his temporary entry permit has expired But if prior to leaving the alien is granted permission to return by the competen offcial and the alien is not barred from entry according to Section 12 and the period of time previosly authorized has not expired then, the alien shall be authorized to stay in the Kingdom for the rest of the authorized time. In asking permission for re-entry, the alien must submit an application in accordance with the form and pay a fee in accordance with the rate and regulations as prescribed in the Ministerial Regulations Summary if the alien is wishing to return into the Kingdom by using the visa previously granted, prior the leaving the Kingdom an alien must obtain a re-entry permit by the competent official. Section 76 : Any alien who fail to comply with Section 37 (2), (3), (4), (5), shall be fined up to no more than Baht 5,000 and additionally fined for every day overstay at Baht 200 per day until he or she is in compliance with law Section 77 : Anyone who violates Section 38 will be fined no more than Baht 2,000 but if the person is a Hotel Manager, he or she will be fines between Baht 2,000 - 10,000 |

หน้าที่ของคนต่างด้าวที่อยู่ในราชอาณาจักร มักจะมีคนต่างด้าวจำนวนมากไม่ทราบว่าเมื่อพวกเขาเหล่านั้นได้เดินทางเข้ามาในราชาอาณาจักรแล้วจะต้องมีหน้าที่ หรือจะต้องทำอะไรบ้าง เราจึงขอสรุปรายละเอียด ที่สำคัญตาม พ.ร.บ.คนเข้าเมือง พ.ศ.2522 ดังนี้ สรุปประเด็นสำคัญ คือคนต่างด้าวจะประกอบอาชีพได้ต้องมีใบอนุญาตทำงานและถ้าอยู่ในราชอาณาจักร เกิน 90 วัน จะต้องแจ้งที่อยู่ต่อสำนักงานตรวจคนเข้าเมือง ตามแบบ ตม.47 ทุก 90 วัน นับแต่วันเดินทางเข้ามาในราชอาณาจักร มาตรา 38 : เจ้าบ้าน เจ้าของหรือเคหสถานรือผู้จัดการโรงแรมซึ่งรับคนต่างด้าวซึ่งได้รับอนุญาตให้อยู่ในราชอาณา จักรเ็ป็นการชั่วคราว เข้าพักอาศัยจะต้องแจ้งต่อพนักงานเจ้าหน้าที่ ณ ที่ทำการตรวจคนเข้าเมือง ซึ่งตั้งอนู่ในท้องที่ ที่บ้าน เคหสถานหรือโรงแรมนั้นตั้งอยู่ภายใน 24 ชม.นับแต่เวลาที่คนต่างด้าวเข้าพักอาศัย ถ้าท้องที่ใดไม่มีที่ทำการ ตรวจคนเข้าเมืองตั้งอยู่ให้แจ้งต่อเจ้าพนัีกงานตำรวจ ณ สถานีตำรวจท้องที่นั้นในกรณีบ้านเคหสถาน หรือโรงแรมที่คนต่างด้าวเข้าพักอาศัยตามวรรคหนึ่ง ตั้งอยู่ในเขตท้องที่กรุงเทพมหานคร ให้แจ้งต่อพนักงานเจ้าหน้าที่ ณ กองตรวจคนเข้าเมือง สรุปประเด็นสำคัญ คือเจ้าบ้านเจ้าของหรือผู้ครอบครองเคหสถาน หรือผู้จัดการโรงแรมเมื่อมีคนต่างด้าวมาพักอาศัยจะต้องแจ้งต่อเจ้าหน้าที่สำนักงานตรวจคนเข้าเมืองภายใน 24 ชม. มาตรา 39 : คนต่างด้าวซึ่งได้รับอนุญาตให้อยู่ในราชอาณาจักรเป็นการชั่วคราวง หากเดินทางไปนอกราชอาณาจักร ให้ถือว่าการได้รับอนุญาตให้อยู่ในราชอาณาจักรเป็นการชั่วคราวดังกล่าว เป็นอันสิ้นสุด แต่ถ้าเดินทางออกไปนอกราชอาณาจักร ได้รับอนุญาตจากเจ้าหน้าที่ให้กลับเข้ามาในราชอาณาจักร ได้อีกและคนต่างด้าวนั้นได้กลับเข้ามาในราชอาณาจักรโดยไม่เป็นผู้ต้องห้ามตามมาตรา 12 ถ้าระยะเวลาที่ได้รับ อนุญาตให้อยู่ในราชอาณาจักร ยังมีเวลาเหลืออยู่ ให้อยู่ในราชอาณาจักรต่อไป ได้เท่าระยะเวลาที่ยังเหลืออยู่นั้น การขออนุญาตเพื่อกลับเข้ามาในราชอาณาจักรอีก ให้คนต่างด้าวยื่นคำขอตามแบบและเสียค่าธรามเนียมตามอัตรา และหลักเกณฑ์ที่กำหนดในกฏกระทรวง สรุปประเด็นสำคัญ คือ หากคนต่างด้าวต้องการกลับเข้ามาในราชอาณาจักรอีก ด้วยวีซ่าตัวเดิม ก่อนออกเดินทางไปนอกราชอาณาจักร ต้องทำ Re-entry ก่อน มาตรา 76 : คนต่างด้าวผู้ใดไม่ปฏิบัติตามมาตรา 37 (2), (3), (4), (5), ต้องระวางโทษปรับไม่เกินห้าพันบาท และปรับอีกไม่เกินวันละสองร้อยบาท จนกว่าจะปฏิบัติให้ถูกต้อง มาตรา 77 : ผู้ใดไม่ปฏิบัติตามมาตรา 38 ต้องระวางโทษไม่เกินสองพันบาทแต่ถ้าผู้นั้นเป็นผู้จัดการโรงแรม ต้องระวางโทษปรับตั้งแต่สองพันบาทถึงหนึ่งหมื่นบาท |
